How to claim your bank charges back.

How did this all come about?

Last year Stephen Hone, a law student from Plymouth decided to take on his bank Abbey National regarding two charges of £32

He asked for his charges back they agreed to refund one.

He challenged that although these charges were in his terms & conditions, they were deemed to be unfair and therefore illegal.

The unfair Terms in Contract regulations (1999) state that all penalty charges have to reflect the real cost of the administration time put in. He believed the penalty charge was higher and therefore challenged these charges by taking Abbey National to court. He also challenged that if these charges were unfair all the charges he had over the past six years were unlawful as well, Abbey didn’t budge and he put a claim in the small claims court which Abbey settled at £840 bank charges refund.

Why did they settle?

Basically none of the banks can justify the costs, I know this because how the Halifax settled mine with no awkward questions, I already advised them what I was claiming, and why - that is the secret, it’s in the correspondence you send them. That is essentially how to claim your bank charges back, and then it’s the negotiations. When the banks were asked the real cost of the administration of these bank charges it came out at about 15% - 20% of the real charge.

Do you think I qualify to claim bank charges back?

If you have had a bank account in the last six years either closed or not and incurred bank charges you are entitled to a refund of the unfair portion of these bank charges. If you can answer yes to that you qualify.

Is it worth me claiming my bank charges back?

I don’t charge a percentage; I charge a flat fee of £250 payable only when you have received your refund. Your claim could be worth thousands.

There must be a catch?

I don’t charge a percentage like most companies. I charge a one flat fee, the cheque will also be made out to yourself, not me.

I have been advised of the dangers of doing things this way but the way I see it is why wouldn’t you pay me £250 after I have got you back a good proportion of your charges as long as they exceeded £250 – and likely to be considerably more.

Simple as I see it!

How long have I got?

In the national press there still appears to be around 2 billion pounds worth of charges not claimed, why should let the bank keep yours?

And we all know how banks work - if they can drum up a way of avoiding to pay the charges they will so my advice is sooner than later.
