That is correct, the DDA does not apply to the judiciary in the undertaking of their duties.. You have a solicitor and I suggest to revert back to the solicitor for advice. It may well be prudent to attend the hearing and have the matter dealt with and closed.

Do exercise caution when accepting offers of assistance from others because many would be no more qualified than your solicitor and may well make matters worse.

Getting paid can be a nightmare. I am owed thousands by bad debtors, and I'm now careful about who I'll do work for. One particular insurance company owes me 30k, but they're based in another country, so I doubt if I will ever see my monty. I would probably name them to protect others, but I don't know if this forum allows it. I do know they owe many other businesses also, and the Daily Mirror named and shamed them.

I also have another company who owes me £13,000. Almost two months ago, I filled in an online application to take them to County Court. I was supposed to get an email with login details, but it didn't come, and I have received nothing in the post to say what is happening.

Has anyone tried using debt collectors? I considered it, but I worried that they may run up a huge bill, and still not get my money in for me. Also, I should imagine that they could probably make the situation much worse.

These are situations faced by too many people in this forum. Isn't there any one lobbying on behalf of small businesses to make it easier to collect these debts?

I used to live in Germany and they had a "Mahnung" system whereby a business could impose fines for late payments, and by late that meant 10 working days.
