Losing my house - how long ? - 28-11-2006, 11:56 AM

If anyone could advise me a few things

Two years ago due to a Legal despute I lost my business, i had alot of unsecured and secured debt and as I wanted to pay back people I woed I seeked advice of a debt specialist

As soon as my mortgage company and decond charge loan found out (as I was in arrears with both) they both took me to court - SMPL got a suspended possession order and Black horse got a something called a deed of postponement

When i first put my IVA togther it was usggested that I could afford around £325 - fater the Inland Revneu postponed the meeting twice saying I was living too comfortable I had to agree to £575

For teh last twleve months or so I managed to keep on top of these things (just) but over the past three months it had been very difficult being able to work without the stress

I have been in constant touch with my creditors but someone in litigation from spml called me out of the blue yesterday and said we are going ot repossess our house - i am not sayingthis but she actually sounded proud of this

She was also abrupt and quite rude - she said that they could get a bayliff out there within a week unless i paid the money now

I managed to creap round her - that took some doing and postponed it until 10am thursday

The amount there asking for is £3900 - needless to say I havernt got that

I have a remortgage going through which I think is wjy I have upset SPML

Questions are obviouly

Where does anyone go when its this close to repossession
What time limits do I really have to raise this money
When i applied on line for an unsecured loan i get letters dsaying they have a loan but I have to send £49.95 first which i dont believe

Can anyone on here who is specilised at this sort of thing get hold of it and help

All I want to do is get on with working to get out of this

Mark how much equity do you have in your house?

You will have to get your insolvency practioners agreement for a refince of your blackhorse loan

Contact your insolvency practioner who set up the IVA. As I understand it if you keep your side of the IVA, your creditors aren't allowed to contact you by law. the only exception would be a new creditor who wasn't notified of the IVA application.
