Problem with CCJ that I didn't know about - 06-05-2008, 07:48 PM

Good evening.

Hope someone can help me with this.

Have obtained a credit report today (due to being turned down for credit) and found a ccj has been put on my name without me having any knowledge of it.

In August 2005 I completed an IVA and cleared off all my debts and was under the impression that my account was clear. One of the debts included in it was for a major bank. They were contacted in August 2003 and informed that the balance would be paid off as it was part of the IVA. My credit report states that the CCJ was created on 01/01/04. I have never been to court with regards this and I have never had any paperwork stating this would be heard in a court of law.

This one was also cleared off in August 2005, but having read my report it states the actual amount was cleared off in August 2005 but the CCJ was sorted in August 2007!!! Now I had no knowledge of this at all and not quite sure how to go about sorting this as it has been quite some time since it was initially placed on my file.

Any ideas??

Not sure about how to approach this one, but maybe start off with contacting the company you had the IVA with.

Then maybe contact your local Citizens Advice Bureau for more advice.

IMO, you need to speak to the court where it was registered, your case number will be on your credit report with the court it was sent to, it is possible to have the ccj "set aside", if you genuinely didn't receive it or other mitigating circumstances, also speak to your IVA company, they sould have dealt with this if it was part of your IVA.

As IVAs usually run for 6 years, than if you completed yours in 2005, then it must have been started in 1999. The insolvency practionaire must have spoken to this particular lender and they must have agreed. You need to speak to the insolvency practionaire who arranged your IVA (please note that he or she may not be part of your IVA company), secondly you have to apply to court to get the judgement put aside (I think the fee for that is £75)
