Arrow Product Liability Insurance - 18-08-2006, 11:51 PM

Hi All,

New boy here! I have joined up because I have a vexing question.

Where can I obtain reasonably priced product liability insurance? I will shortly be launching an 'online only' retail business and would like to get the cover in place ahead of that. Anyone got any suggestions?

As my customers will be visiting a virtual shop I don't believe I need public liability cover, but so far I have only been able to find product liability combined with public liability, which makes it much more expensive.

Does anyone have any experience of this?

Any help would be appreciated.

Only me again ...have I really stumped everyone with this???

I have found out a bit more myself. It appears that so long as there are certain procedures in place (from the retailers point of view), it is largely the manufacturer who will bear responsibility for any damage or injuty claim.

I would still be delighted to hear of any experiences anyone has had.

I'm not sure how true that is as I think that the customer's contract is with yourself and not with the manufacturer who for all we know could be operating out of Taiwan where the Health & Safety laws are very different to the UK

I have an affiliate link on my website to a company that provides online quotes for a variety of insurances including schemes for retailers that incorporate product liability. Have a look and see if they meet your needs.

Thanks for your reply.

I agree, the customers contract of sale is with the retailer, but I think it's a bit different when it comes to product liability.

The procedures I mentioned include being able to identify the manufacturer and being able to prove the goods were faulty on receipt. It seems to boil down to the fact that they are not allowed to produce defective goods.

The whole thing is long winded and complicated as you might expect, and it's a steep learning curve for me!

Yes, contract is with the customer but claims for products causing injury is nothing to do with the law of contract but the law of tort. Manufacturers are often liable for any injury caused
