Alleged Harassment of a Company!

I have been accused by the Police of harassing a company by posting information about rulings made by the government-approved regulator of the industry that the company is a member of.

There is no suggestion that the information is in any way defamatory. I have merely published factual information. The postings were always made in reponse to aggrieved customers posting of their dealings with the company and who have lost money as a result.

I do not see how this can amount to harassment and I can find no case law on this.

This alone is not likely to be harassment but I suspect there must be more to it for the Police to expend their time on the matter.

Maybe so, this is a seperate issue to the allegation of harassment.

Who has determined the facts were indeed facts and more importantly, whether the facts were correct and founded. You are relying on what your customers say - this is risky.

This is not something Fred Bloggs can google to ascertain their legal position. Lawyers exist for this purpose and you should seek immediate advice.

The Police dropped the case. I was never charged with any offence. The police did not even look at any of the material they removed from my house, as it was all returned in the same sealed bags they put the items into at my house.

After the police interview I got a letter from the company's solicitor indicating civil action. I wrote back to the solicitor, enclosing documents about the company. The Solicitor no longer has dealings with the company and the managing director has set up a new company (with an almost identical name). The older company is now being looked at by the Insolvency Service.

A friend of mine had service with the older company and lost money when his mobile phone was cut-off 7 months into a 24 month contract (he paid line rental up-front for 2 years). When my friend asked for repayment of line rental, the managing director threatened to report him to Police for extortion! My friend took his case to CISAS and won a judgement. The company never submitted any defence and has totally ignored the ruling by failing to pay the money that CISAS ordered the company to pay.
