Can the director of a PLC be sued?
10-12-2007, 02:18 PM
  #1

hello,
i have a small company which is a private limited company.
i have an american client who asked me to hire a law firm for them,
unfortunately they didn't pay the law firm and now the law firm wants to attack my english company.
i am the director and sole member of my company.
can the law firm attack me personally?
i was told the corporate veil can be lifted in certain cases, is this true?
also, if i end up closing my company, due to insolvency, does that mean i can never open up an english company again?
thank you!

You appear to be running a Ltd company and not a PLC which has a different meaning in English Law. Do you run a UK based Ltd company? If so then yes under certain circumstances it is possible to also sue a director personally. This would depend on the circumstances and the extent of the director's involvement so you should not hesitate in taking legal advice on your position.
