Court process - MFI in court
14-01-2007, 06:13 PM
  #1

I have taken MFI to court over a faulty worktop. Prior to the hearing however, we reached an agreement and both parties signed a consent order which they court approved. However, MFI failed to pay the settlement by the due date stipulated on the order, so I have asked the court for advice on what action can now be taken. Following this, MFI sent the cheque, which I have returned. Does anyone know what the likely process would now be, and whether I am likely to be liable for their costs which they are theatening? I would have thought as the defendant did not carry out the obligations under the consent order, the claim process re-starts?
