Debt Solution Question - 16-08-2007, 10:20 AM

Hi

I am looking to start up a website to offer advise to people in debt. I was once in debt and would like to offer my experience. I am looking for an alternative to bankrupcy and IVA's.I found out later that there is the "penny in the pound" payment rule which was explained to me after I went bankrupct. I wanted to know if this would actually work and if there is any legal documentation to back it up. Also my friend said that if you make debtors an offer and they refuse they cannot take you to court??? Failing this I am looking at the best possible advice to give to people to avoid going into Bankrupcy or an IVA. I would be greatful for any advice you can give.

Yeah there is no possible way you can take them to court if you make them an offer and they refuse. It's their prerogative to deny an offer.

it is surprising you are looking to provide specialist financial information that could greatly affect someone's life and asking for said information on a public forum from people who's credentials you do not know.

Thankfully, if this is how you will approach the whole project the citizens advice bureau need not worry about the opposition.

I'm not sure how to prove something isn't true other than to say if that were the case everyone who couldn't afford to pay their debts would offer £1 and the County Courts would then shut down from disuse.

Whats what with trying every conceivable source to find out the best forms of debt solution? Thankfully if you are this ignorant I am glad you didnt provide an answer.

Your friend is sadly mistaken. I wish it were like that but it isn't. There are several sites that provide a "discussion forum" for people on legal matters ranging from debt related questions to pure law to law and the PI (mine). I say discussion because if someone really needed advice they should approach a solicitor in the 1st instance. I am not ignorant, my answer was that debt counseling is a very specialised subject and could have a huge impact on people. You want to go into this field and yet question a quite basic aspect ?

You are correct in trying finding out the ins and outs of any legalility but you should have some knowledge of the basic facts before you decide on this as a vocation.
