I was wondering if someone could assist me. I have been asked to look into this problem for someone I know, who is having to deal with of a legal issue.

They have a web site for enterntainment work that they have carried out in the past and on it until recently they have had some photos of themselves and their partner. Unfortunately there has been a falling out between both parties and all of a sudden the other party has sent a bill for 2 years of what they call 'fair usage' of the images. The images actually were taken by a professional photographer and not by the other party.

Are they allowed to charge for fair usage of the photo? And if so would they have to provide proof of the period of time the image was on the web site? Are there any other issues they should be considering?

Any assitance with this matter would be greatly appreciated.

That's just daft. Send them a bill for the use of your image in generating their income.
