the law for the sole trader

Is there a way to register a business name when you are a sole trader, so that no-one can take it?

Ik now this happend when you register an LTD, but i cannot do that at the moment, and i want to be a sole trader anyway...Is there a way to protect the business name, or do the LTD's, PLC's etc have priority?

Hello Miro

Whether you’re a limited company or a sole trader the only watertight way to protect a business name is to register it as a trade mark as this will give you national protection.

Forming a limited company can afford some protection but in reality it only stops someone else from forming another company with the same name. Seeing as a limited company doesn’t even have to trade under its registered name it’s not too difficult to get around this “protection”.

How would i go about registering it as a trade mark? How much would it cost?

I cant find anywhre on that post saying how to register a trade mark...

I believe you can register your business on the 'The National Business Register' which costs around £60, for further info their web address is somewhere that redirects

Registering your business name with the National Business Register offers you no legal protection over your name whatsoever. As has been posted previously on this forum the only sure fire way to protect your business name is to trademark it.

Don't know if LM Briggs is connected to the aforementioned link but is it ABSOLUTELY INCORRECT that a website like this offers ANY legal protection. If you want full legal protection get the mark registered as a trademark which can cost as little as £250 (without a lawyer or trademark attorney)

If any website claims to protect your business name and ask for a payment, sue 'em for misrepresentation!
