Lease assignment - 26-02-2008, 11:40 AM

Hi everyone

I am new to this site so be patient with me!!!
I used to own a small business which I sold in May 2007. However the lease was never assigned to the new owner. I have continued to work for the business part time and have assisted the new owner. Due to personal problems and separation from my partner I also became insolvent in Nov 2007.
The new owner would now like to sell the business also. He has 5 prospective purchasers. The landlord is being difficult and wishes the 5 years remaining on the lease to be assigned when all the prospective purchasers would like a new 10 year lease. If I was to include my lease liability in my bankruptcy what rights would the new owner have trading in the premises and would he still be able to sell the business. He has paid the rent for the last nine months and no arrears are outstanding.
