Legal Advice Needed Please - 23-10-2006, 11:43 PM

Hi everyone,

I was working over in Germany where I was a passenger in a road traffic accident that was the fault of another driver who seems to have admitted responsibility. I have a few questions linked to this incident and would appreciate any advice anyone has to offer :-)

I have received letters from the hospital over there, billing me for the emergency care I received immediately after the accident. Do you think I should pay for this now and then try to obtain a refund from the insurance company of the driver responsible or should I approach the company I work for to check if the travel insurance they should have taken out on me covers these costs?

Also, could anyone recommend on the steps I need to take now to resolve this issue most effectively - this is all new to me as I have never been involved in a serious accident and never needed advice from a solicitior.

You do need specific advice from a solicitor because there are overlapping issues that need further clarification. I do not deal with personal injury claims so I cannot advise you

Hi Jonathan,

Thank you for your reply.

At the moment I have filled the forms for 2 solicitors, so I am waiting to hear from them. I'd like to ask you a question if that is ok - Given that I was abroad on company business, would this mean that the company I work for is liable in anyway or a case could be persued with them? The reason I ask is because I am not very happy about the way they are handling my sickness. Certain remarks made by one manager are causing anxiety and stress, especially because I have only been employed in this position for roughly 6 months. If you could provide any advice you feel is relevant I would greatly appreciate it. If you need any more info please do let me know.

Your employer may be vicariously liable. You need to obtain specific advice from a solicitor who will examine your circumstances and advise accordingly. The employer should have insured employees whilst abroad on employer business.

Claims for personal injury are generally statute-barred after 3 years

who was the driver of your vehical, get in contact with them, there insurance company may be able to help you claim costs.if you need help after that just ask.
