Personal Injury Claims - 29-07-2008, 04:02 PM

My wife recently had a slip at work and has now hurt her back. The trouble is she is good friends with every one she works with especially her manager and feels she doesn't want to deal with accident/ injury claims that you always hear about. Has anyone dealt with any kind of comepensation claim as I want to convince her it is worth going through with?

Firstly this is really not a claim against your wife's employer but more a claim against their insurance policy and would be dealt with by them. There are lots of solicitors who deal with this sort of work on a no win no fee basis and the best advice is to go to one local to you. I was a personal injury solicitor for many years and ideally you should be looking for a solicitor who specialises in back injuries and who only deals with PI claims.

If your wife instructs a solicitor the claim will be dealt with between the solicitor and her employer's insurance company so she will not be dealing directly with the claim herself nor will she have to deal with any correspondence from her employer/insurer.

Most solicitors will offer a free initial appointment so she can find out where she stands and what the process involves. Personal injury claims are run on a no win no fee basis (but check she won't get charged for medical reports and that she'll get 100% of her compensation). Look for a solicitors firm registered with the Association of Personal Injury Lawyers (APIL) as they will have to meet set client care standards.
For peace of mind, see if the firm do Employment law as well and then if is any difficulty with her employer, they can help with that too.
