Hi,

I need some advice regarding names i can use for a bar i just purchased - i have a few in mind but am not sure if they have been used already, i know my company name cannot be used by anyone else, and trademarked names such as yates or slug and lettuce etc cannot be used by anyone else but what is the standing on untrademarked names used only as shop or bar names etc?

Any help would be much appreciated as i dont want to use a name then have to change it!

From my understanding, you can use any company name as long its not been registered.

Simply MR Smith Trading as "John Smiths pub"

Does not automatically protect John Smiths Pub and could actually be forced to change his name if someone else registered it.

With regard to trademarks, its more of a who registers that name first and once registered only the owner can use / trade with it

However this is a interesting topic as Apple got taken to court regarding its Iphone branding which it did not protect and was landed with a nice bill for not doing so when another company who did register it took legal action.

So if the Company Name / Trademark is really important then get it registered.

I would go with something to do with the location, either the address or the area the bar is in. this will associate the bar with the area.

I have seen many places with just a number (relating to the street number) etc.

It needs to be something memorable. Would need to know more about the bar and the location to suggest anything specific.
