Sick pay -

Hi,
I have a member of staff who was employed to cover maternity leave for 16 hours/week, we kept her on for a short while after the maternity period. She has now phoned in sick indefinitely, can we just end her employment or do we have any legal obligations re sick pay? No contracts were signed. Thanks Fred. |

You need to follow the ACAS process for termination and also take into account your own rules on sickness for a prolonged period. You should not terminate her employment without taking legal advice as it can be very risky. Have a look at our free advice section on the HR part of our site.

Hi Fred,
Depending on the length of employment, it is possible that you could terminate the contract (despite no contracts being signed they are in place legally!) now, but it would be advisable to take further advice, with due consideration to the full circumstances of the case. And indeed whether termination is the most appropriate step. |
