Question Waiver of Liability - 12-06-2008, 02:44 PM

I belong to a re-enactment society that requires everyone to sign a waiver of liability at every event that we have regardless of whether the person is fighting with weapons or not. I have been told that you cannot sign away your right to sue in the UK and the waivers are not worth the paper they are printed on.

Can someone tell me if this is true?

You cannot abrogate responsibility. The event organiser is responsible for ensuring the safety of all participants. If I get injured because you did not brief the members on the rules or ensure that the equipment used was fit for purpose then I am within my rights to sue. This is why you must have public liabiliy insurance.


Effective Web Design - It's not that difficult if you follow the rules.

You cannot exclude personal injury and so even if such a waiver is in your terms it would not be valid.
