Changes to business stationery rules

As from 1st January 2007 the following applies to –

Business Stationery

Whether in hard copy, electronic or any other form:

A company must state its name, in legible lettering, on the following -

* all the company's business letters;
* all its notices and other official publications;
* all bills of exchange, promissory notes, endorsements, cheques and orders for money or goods purporting to be signed by, or on behalf of, the company;
* all its bills of parcels, invoices, receipts and letters of credit

On all of its business letters, order forms or any of the company’s web sites*, the company must show in legible lettering –

* its place of registration
* registered number
* its registered office address
* and if it is being wound up, that fact,

*A web site is not a company’s web site if, it’s content is determined solely by persons other than the company, or it does not relate to the company, its business or operations

The above also applies to Limited Liability Partnerships.

This should not affect too many companies. We have no problem putting this information on our websites. We have nothing to hide and people are pleased to deal with us as an LTD.

However, I do know that many LTD's run from home and they may not want to put all this info on their websites. We assist many companies by providing registered office services and mail forwarding so that they can display the legally required information.

It is only fair that if you are dealing with an LTD and not a soletrader that you know this fact.

Quick question: Is this the registered office or the trading address that needs to be put on? Our registered office is at our accountants, but our trading address is an office elsewhere. We've just had a LOAD of stationery done, so that will be a real pain in the @ss if we have to reprint it all

Curious on this one ...

Why is it a pain? Your letterhead should already have had your accountants address on it if it was your registered office address. If so then you don't need to do anything.

Hi. Can someone clarify this ruling for me please.

Does it apply to Sole Traders at all? If so, is a PO Box acceptable?

I'm working from home, so don't want to publish my home address on my website. Have purchased a PO Box. I'm now not sure that this will be acceptable, or if I do indeed need to quote an address on my website as a Sole Trader.

Other legislation may apply to sole-traders such as the Business Names Act, Distance Selling and Ecommerce Regulations, etc
