Sick note during notice

Hey,

I have recently given an employee notice to terminate their contract..during the notice period they have brought in a sick note for a longer period than the notice...its my understanding that since the sick note was recieved AFTER notice served - I only have to honour it until the last day of notice...

Can any clarify if this is correct..?

i would not like to take a guess for you here , esp as the rules in England differ greatly from those here in Sweden - best advice from me to you would be make a call to CAB and ask for their advice.

ACAS won't give specific advice to an employer. If you have the appropriate insurance in place there may be access to legal advice over the telephone. Further investigation required as to the circumstances leading to the dismissal to ensure compliance.
