Terms and agreements. - 29-04-2007, 06:47 AM

How does terms and agreements work?
Like, say if I started an online business, And provided them with a service. I then send an email to them, telling them about the service. And just before I send them to a certain link, I want them to agree to pay me, but only if they complied with the service. Something like that. Is that like an contract or something and whats the legal requirements for something like that, and how do you write such a thing.

For any terms in your terms and conditions of business to be legally binding you need to ensure that your clients have access to these terms prior to the undertaking of any services. How this can be achieved with your business depends how you accept orders, instructions etc from clients.

In any event, you should consider getting the terms and conditions drafted by a lawyer, who may well also advise how to incorporate the terms into any contract you enter into to ensure its effectiveness and more importantly, its enforcability

Whats a qoutation, also getting a lawyer to draft may cost right?

Quotation is an indication of a fixed cost to do any work. You are under no obligation to accept.

We do not charge as much as the high street lawyers!

So, how much would it charge, if I wanted you to draft a terms and agreements, oh and I'm 15 so is there other stuff involved?

Also just a few more questions.

If my company hasn't started trading, nor had any income. Do I need to fill out any forms at the end of the year?

Also how should I make a share register? Can you give me a template for it.

What other records do I need to keep? And how should I make them?

On paper or put them on my computer?

Do I have to make a balance sheet and income statement even when my business hasn't started? but I have registered it.

GST, what am I supposed to do with that? In that form, it had said a company has to prepare financial statements annually. If the business hasn't got started, do I have to do them? If so, how?

If I do have to make these forms, where do I send them to?

I have registered a company, yet I still haven't received my companies IRD number what should I do?

If I have registered as a company, does that mean I cannot be a sold trader? (On the NZ company website)

Since I am starting an internet service kind of business, what source documents do I need to keep?

Also is there some way I can automatically do it for me? If I wanted to have someone pay using credit card, and since I am 15, how can I work that into my business? because apparently I don't have a credit account.

There is little point in me answering the post as the laws may well differ in New Zealand
